It’s not misleading at all. The comment on lenses, even if it was hypothetically a confirmation of anything, carries no dates.

It is quite misleading as the official statement talked about new developments specifically relating to lenses which were unnannounced, which are comments “likely to create a false impression” about product specifications and accessories.
If Pimax never releases a new, totally different controller design as they said then thats a clear cut case for false advertising.

Listen man, “Regarding lenses, there is a lot I wish I could tell you, but at this point I cant.” is not misleading at all. That could be in regard to better replacement lenses in the future. Not to mention the pre-orders came up today, and nothing of new lenses was mentioned at all in Pimax Day 2. Why’ed you even pre-order one? Just to complain that it has no new lenses? Not even to mention, that you can probably still cancel your pre-order if you just email Pimax. Obviously you’re just looking to make financial gain off this.
Sure. We can agree on that. However if no updated controller design and updated tracking design is ever released or if no lenses are ever released as confirmed, then its clearly false or misleadibg advertising, as the official comments on those matters give a misleading impression.
“Vision” as a term may be puffery, but there’s no going around the other matters I raised as misleading statements, if not clear cut false advertising. Only time will tell for sure.
And i’m not here to sue Pimax or backcharge them for financial gain, I just hate companies lying and misleading consumers. Lying in general is one of the only things that triggers me.
No new lenses were EVER confirmed. For all we know he could be talking about how there will never be new lenses and he can’t tell us that. Why are you so heated over these new lenses? If it really bothers you just cancel your pre-order.
I assume your taking this same lawsuit to the Oculus forums. They are clearly misleading the community with their Half-dome prototypes

The comment about specifics of product specification (lenses) is misleading, as it talks about new unnanounced developments to the lenses which cannot be talked about. If they were the same lenses, there is no reason they could not talk about them.
Which is why the advertising is misleading and creates a misleading impression, as we’re still getting the same lenses but we were mislead to believe that other lenses are in devopment (Swevivers reply was in response to a question asking about the 8KX)
